Terms of Use

Aragon Way Insurance is a licensed Property and Casualty insurance agency in the State of Florida (License No. L123150). Nothing on this Site constitutes an offer, solicitation, or binding commitment to provide insurance coverage. All coverage is subject to underwriting approval, policy terms, conditions, and exclusions.

These Website Terms of Use (“Terms”) govern your access to and use of https://aragonway.com and any subdomains or related pages (collectively, the “Site”), operated by Aragon Way, Inc. dba Aragon Way Insurance (“Aragon Way,” “we,” “us,” or “our”). Any quote, estimate, indication of pricing, or preliminary assessment of coverage availability generated through or in connection with the Site is not a binding offer or commitment. All such indications are preliminary, subject to change, and may be withdrawn at any time prior to issuance of a policy and receipt of required premium. Coverage is not effective until a policy has been formally issued by the applicable insurance carrier and any required premium has been paid.

Aragon Way expressly disclaims any liability arising from your reliance on information obtained through the Site.

2. Licensing, Regulatory Status, and Geographic Limitations

Aragon Way, Inc. d.b.a. Aragon Way Insurance is a licensed Property and Casualty insurance agency in the State of Florida, License No. L123150. Aragon Way operates in accordance with applicable Florida insurance laws and regulations. Aragon Way Insurance’s licensure in the State of Florida does not necessarily constitute authorization to sell, solicit, or negotiate insurance in other states or jurisdictions. Coverage availability, product offerings, and regulatory requirements vary by state and jurisdiction. If you are located outside of Florida, please consult with a licensed insurance producer in your state regarding coverage availability and requirements.

Nothing on the Site alters or supplements Aragon Way Insurance’s obligations under applicable state insurance laws and regulations. In the event of any conflict between these Terms and applicable law or regulation, applicable law or regulation controls.

3. Eligibility

The Site is intended for users who are at least 18 years of age and have the legal capacity to enter into binding agreements. By using the Site, you represent and warrant that you meet these requirements. If you are accessing the Site on behalf of a business entity, you represent that you have the authority to bind that entity. Use of the Site from jurisdictions where its content or use is unlawful is prohibited.

4. Electronic Communications Consent

By using the Site and providing your contact information, you consent to receive communications from Aragon Way electronically, including via email or notices posted to the Site. You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law. Aragon Way assumes no special security obligation for sensitive information submitted outside of a designated secure process.

10. Disclaimers of Warranties

THE SITE AND ALL CONTENT AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARAGON WAY INSURANCE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ARAGON WAY INSURANCE MAKES NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CONTENT ON THE SITE. YOUR USE OF THE SITE IS SOLELY AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARAGON WAY INSURANCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY ASSERTED. IN ALL CASES, ARAGON WAY INSURANCE’S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).

Some jurisdictions do not allow certain damage exclusions, so the above apply to the maximum extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Aragon Way and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your use of the Site; (b) your submitted content; (c) your violation of these Terms; (d) your violation of any applicable law; (e) your violation of any third-party rights; or (f) any misrepresentation made by you, including misrepresentation of your identity, qualifications, or authority.

13. Dispute Resolution

Informal Resolution. Before initiating any formal legal proceedings, you agree to contact Aragon Way at insure@aragonway.com with a written description of the dispute and relief sought, and to allow thirty (30) days for informal resolution.

Limitations Period. ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE EVENT GIVING RISE TO THE CLAIM, OR IT SHALL BE FOREVER BARRED.

Governing Law; Venue. These Terms are governed by the laws of the State of Florida. Any dispute not resolved informally shall be brought exclusively in the state or federal courts in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts.

Regulatory Rights Preserved. Nothing in this section limits your right to file a complaint with the Florida Department of Financial Services, the Florida Office of Insurance Regulation, or any other applicable regulatory authority.

14. Changes to the Site and Terms

We may update, modify, suspend, or discontinue the Site at any time without liability. Updated Terms are effective upon posting. Continued use constitutes acceptance.

15. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, Cookie / Tracking Notice, and SMS / Text Messaging Terms (where applicable), constitute the entire agreement between you and Aragon Way regarding your use of the Site.

Severability. If any provision is found invalid, it will be modified to the minimum extent necessary, and the remaining provisions continue in full force.

Waiver. No failure by Aragon Way to exercise any right constitutes a waiver.

Assignment. You may not assign your rights under these Terms. Aragon Way may freely assign these Terms.

Force Majeure. Aragon Way is not liable for failures due to causes beyond our reasonable control.

Regulatory Supremacy. Nothing in these Terms limits or waives any obligation imposed by applicable Florida insurance laws or regulations. Where any provision conflicts with a regulatory requirement, the regulatory requirement controls.
