SMS / Text Messaging Terms
Aragon Way Insurance is a licensed Property and Casualty insurance agency in the State of Florida (License No. L123150). These SMS Terms govern both operational and marketing text message communications. Your consent to receive marketing messages is never a condition of obtaining insurance products or services from us.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

These SMS / Text Messaging Terms (“SMS Terms”) govern text message communications sent by or on behalf of Aragon Way, Inc. dba Aragon Way Insurance (“Aragon Way,” “we,” “us,” or “our”). We operate two types of text messaging programs: (1) operational and service communications with existing customers, and (2) marketing and promotional communications where you have provided express written consent.
Your consent to receive text messages is not a condition of purchasing or receiving any insurance product or service from Aragon Way.
1. Program Types
A. Operational / Service Program
Our operational program is limited to non-marketing communications with existing customers, including:
- Policy and account notices, updates, and reminders;
- Renewal notices and coverage change notifications;
- Appointment scheduling, reminders, and confirmations;
- Claims status updates and service follow-ups;
- Administrative notices related to your account.
B. Marketing Program
Our marketing program includes promotional communications about insurance products, services, and offerings, including:
- Information about available insurance products and coverages;
- Promotional offers, discounts, or incentives;
- Event invitations and educational content related to insurance and risk management;
- Other marketing and promotional content we believe may be of interest to you.
2. Consent Requirements
A. Operational / Service Communications
For operational and service communications with existing customers, consent is generally implied by the existence of your customer relationship with Aragon Way Insurance and your provision of a mobile phone number in connection with that relationship. We will not send operational texts to individuals who have not provided a phone number in connection with their account or who have opted out.
B. Marketing Communications
For marketing communications, we are required by law to obtain your express written consent before sending any marketing texts. Express written consent may be obtained through:
- A written or electronic opt-in form clearly describing the marketing messaging program, message frequency, and applicable terms;
- A clear and conspicuous unchecked checkbox on a quote, application, or account form with disclosure of the program;
- Any other method constituting express written consent under the TCPA and applicable FCC regulations.
By providing express written consent for marketing texts, you represent that: (a) you are the account holder or authorized user of the phone number provided; (b) you are at least 18 years of age; and (c) your consent is entirely voluntary and not a condition of any purchase or service.
3. Message Frequency and Costs
Operational message frequency varies based on your account activity. Marketing message frequency will vary and will be disclosed at the time you opt in. Message and data rates imposed by your wireless carrier may apply. Wireless carriers are not liable for delayed or undelivered messages.
4. Quiet Hours
For marketing messages, we will not send text messages before 8:00 AM or after 9:00 PM in your local time zone, consistent with applicable TCPA requirements and CTIA guidelines. Operational messages relating to urgent account or claims matters may be sent outside these hours only where operationally necessary.
5. How to Opt Out
• Reply STOP to any text message to opt out of all messages from that sending number. We will send a final confirmation.
• Email insure@aragonway.com specifying whether you wish to opt out of operational messages, marketing messages, or both.
• Call 1-561-830-3360 and request removal from the applicable program.
Once you opt out of a program, we will not send further messages under that program except as required by law or to confirm your opt-out. You may opt back in at any time by contacting us or following the opt-in process in Section 2.

7. Privacy and Data Handling
We do not sell your phone number or SMS opt-in consent. We do not share your phone number or SMS opt-in consent with third parties for their own independent marketing purposes.
We may use third-party messaging platforms to deliver text messages on our behalf. These providers act as our service providers and are not intended to use your information for unrelated purposes. The specific providers we use may change from time to time.

8. TCPA Compliance
Aragon Way designs its text messaging programs to be consistent with the TCPA, applicable FCC regulations, and CTIA guidelines, including obtaining appropriate consent for each program type, honoring opt-out requests promptly, observing quiet hours for marketing messages, and clearly disclosing program terms at the time of consent. We periodically review our practices as applicable law and carrier guidelines evolve.
9. Disclaimer; Limitation of Liability
TEXT MESSAGES ARE PROVIDED AS A CONVENIENCE. ARAGON WAY INSURANCE DOES NOT GUARANTEE THE DELIVERY, TIMELINESS, OR ACCURACY OF ANY TEXT MESSAGE. WIRELESS CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES. ARAGON WAY INSURANCE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM DELAYS, ERRORS, OR FAILURES IN MESSAGE DELIVERY OR UNAUTHORIZED ACCESS TO MESSAGES IN TRANSIT. ARAGON WAY INSURANCE’S TOTAL LIABILITY IN CONNECTION WITH ITS TEXT MESSAGING PROGRAMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).
10. Changes to These SMS Terms
Changes take effect upon posting an updated version with a revised effective date. Continued participation constitutes acceptance.
