Producer Compensation &
Conflict of Interest Disclosure
Florida law requires licensed insurance producers to disclose material information about compensation arrangements that may influence placement decisions. This Disclosure is provided in compliance with applicable Florida insurance statutes and as part of our commitment to transparency with our clients.
1. Our Role
Aragon Way, Inc. d.b.a. Aragon Way Insurance acts as a licensed insurance agent and broker. Depending on the circumstances of a particular transaction, we may act as your agent (representing your interests in placing coverage), as an agent of the insurance carrier (authorized to bind coverage on the carrier’s behalf), or in a dual capacity. We will disclose our role to you upon request or at the time of placement if it is material to your transaction.
2. How We Are Compensated
Aragon Way Insurance is compensated for its services primarily through commissions paid by insurance carriers. These commissions are typically calculated as a percentage of the premium on policies we place and are paid by the carrier, not directly by you as the client. Commission rates vary by carrier, line of business, and policy type.
In addition to standard commissions, we may receive the following types of compensation from insurance carriers:
- Contingent or Profit-Sharing Commissions: Some carriers pay additional compensation based on the profitability, volume, or growth of business we place with them over a specified period. These arrangements may create an incentive to favor carriers that pay contingent commissions, even if another carrier might offer you comparable or superior coverage at a lower price.
- Override Commissions: Some carriers or managing general agents (MGAs) pay override or supplemental commissions in recognition of volume or other business criteria.
- Other Compensation: We may receive non-cash compensation, training, marketing support, or other benefits from carriers or MGAs in connection with the placement of business.
Specific commission rates and amounts applicable to your policy are available upon written request. If you would like to know the specific compensation we expect to receive in connection with your placement, please ask us before your policy is bound.
3. Technology Partner Relationships
Aragon Way Insurance works closely with managed service providers (MSPs), technology advisors (TAs), value-added resellers (VARs), and other technology partners in connection with our cyber insurance business. These partners may refer clients to Aragon Way Insurance or collaborate with us in assessing a client’s technology risk profile for insurance purposes.
Aragon Way Insurance does not pay referral fees, commissions, or any other compensation to technology partners or other unlicensed persons for referring insurance business or clients to us. The payment of fees or other compensation to unlicensed persons for insurance referrals is prohibited under Florida law (see Section 626.112 and Section 626.9541, Florida Statutes). Any compensation arrangements with technology partners relate exclusively to services they provide in their capacity as technology service providers, not to insurance placement or referral activity.
Technology partners who work with Aragon Way Insurance do so in the context of their existing technology service relationships with clients. Any insurance discussion that arises in that context is initiated independently by Aragon Way Insurance and does not result in compensation to the technology partner.
4. Potential Conflicts of Interest
The compensation arrangements described above, particularly contingent and profit-sharing commissions, may create potential conflicts of interest in that they could provide an incentive to place business with carriers that compensate us more generously, rather than solely on the basis of what is best for you as the client. We are committed to placing coverage that is appropriate for your needs and consistent with our duties as your agent. However, we believe you should be aware of these arrangements so you can make informed decisions.
If you have concerns about potential conflicts of interest in connection with your placement, please discuss them with us. You have the right to ask us to disclose all compensation we expect to receive in connection with your policy and to seek competitive quotes from other producers.
5. Your Right to Ask Questions
You have the right at any time to:
- Ask us to explain the compensation we receive or expect to receive in connection with any placement;
- Ask us to seek competitive quotes from other carriers;
- Request that we act solely as your agent and not as an agent of any carrier in a particular transaction;
- File a complaint with the Florida Department of Financial Services if you believe our compensation arrangements have improperly influenced our recommendations.
